According to Florida guardianship laws, the family members or loved one of an individual considered by the court to be incapable of self-care may be granted guardianship over the individual as long as they meet the state's standards for guardianship. A person that has lost the faculty and capability of making medical or financial decisions on their own will be assigned to a guardian for everyday and important life decisions. A court has to determine that the individual lacks the capacity to care for him/herself. The court will appoint a panel of medical professionals to assess the mental or physical capabilities of the person. The panel will issue a conclusion and recommendation as to whether the person needs guardianship and to what extent. Guardianship may be granted to any citizen of the state that is determined to be of sound mind and is at least eighteen years of age. Guardianship to a non-resident of Florida is only granted if the person is a blood relative. The guardian will have to place all the assets of the afflicted individual in a deposit account and will only have access to the resources with a court order.
